Dostoevsky as a Symbol of Anti-Juridism in the Philosophical Theology of Law in Karl Schmitt, Archpriest Sergiy Bulgakov, and Eugen Rosenstock-Huessy

The article examines the attitude towards Dostoevsky and the heroes of his works in the works of the 1920s by Karl Schmitt, Sergei Bulgakov and Eugen Rosenstock‑Hussy. The basis for a comparative analysis of the views of these outstanding intellectuals is their legal education and the attention to the “law and religion” issues. Dostoevsky’s heroes became for these thinkers in the 1920s a symbol of anti‑legalism, but their interpretation of this symbol differs, which becomes the subject of study in the article. Starting from texts where references to Dostoevsky allow these legal philosophers to give their own diagnosis of the post‑World War I era, intersections and differences in their thoughts are demonstrated. The importance of the attitude towards Dostoevsky for the evolution of their own teachings, as well as their ideas about Russian culture and its place in world history, is shown.
